T’s and C’s of Sale to Consumers (Online) – Polly’s Brew Co. Ltd

You must be at least 18 years of age to buy our alcohol products.

As you’ll know, it’s illegal to buy alcohol if you’re under the age of 18. It’s also illegal to buy products containing alcohol for others under the age of 18.

By placing an order through our website, you confirm that you are at least 18 years of age and do not intend to give those products to anybody under that age.

All orders must be signed for a person of at least 18 years of age and we reserve the right to cancel your order if your age cannot be confirmed.

These terms

These terms tell you who we are, how you can place an order through our webshop, how and when we will provide our beer and other products to you how you, and we may change or cancel your order.

These terms also let you know what to do if there is a problem with your order, so please do read them before submitting your order.

Information about us and how to contact us

Who we are. We are Polly’s Brew Co. Ltd, a company registered in England and Wales. Our registered company number is 11294980 and our registered office is at Holland Farm, Black Brook, Mold, Flintshire, CH7 6LU. Our registered VAT number is 229532208.

Contacting us about your order. You can contact us by email to shop@pollysbrew.co or by sending us a message through the ‘Contact Us’ page on our website.

Our contract with you

How we accept your order. As soon as we email you confirming your order has been placed and accepted, we will start working to get your beers and other products dispatched and delivered to you.

If we cannot accept your order (for example, because the product you’ve ordered is out of stock, or because of unexpected limits on our resources), we will let you know by email and won’t charge you for the products you’ve ordered.

Your order number. When we confirm your order has been placed, we will give you an order number. It will help us if you can tell us the order number whenever you contact us about your order.

Your rights to make changes

If you’d like to make changes to your order once it has been placed, please contact us and we’ll let you know if the change is possible. We’ll also let you know about any changes to the cost of your order, as well as how long it may take for your order to be dispatched.

If we cannot make the change or the consequences of making the change are unacceptable to you, you may want to cancel your order.

Providing the products

Delivery costs. Where you choose to have your products delivered to you by courier, the costs of delivery will be displayed to you during the online check-out process. Typically we charge a flat rate of £6.99 for delivery to locations within the United Kingdom.

Free Delivery. As of April 2022, we offer free delivery on orders over £60 (although this is subject to change from time to time). Where we do offer free delivery on orders, we will let you know at the time of placing your order.

Dispatch. We try to dispatch all orders within three days of them being placed. We will let you know if there is likely to be any delay to dispatching your order.

When you will receive your order. Our courier will contact you with the estimated delivery date once your order has been dispatched. If delivery is likely to be delayed by an event outside of our courier’s control, they will contact you to let you know. Provided they do this, we will not be liable for delays caused by the event.

If there is a risk of substantial delay, you may contact us to cancel your order and receive a refund for any products you have paid for but not received.

Collection by you. You may also choose to collect your order direct from the brewery. To do this, you must book in advance a date and timeslot for collection when submitting your order.

Timeslots for collection are available Monday – Thursday each week, between 09:30am and 16:00pm (subject to availability).

If you can’t take delivery of products. If no one over the age of 18 is available to take delivery, our courier will leave you a note informing you of how to rearrange delivery.

If you do not re-arrange delivery or collect your products, we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If we are unable to contact you or re-arrange delivery or collection, we may cancel your order and provide you with a refund.

When you become responsible for the products. You will be responsible for your products from the time they are delivered to your address (or from the time you collect it from us).

Late delivery. We will aim to ensure that all orders are delivered to you within the specified time estimates, but we exclude any liability for delays.

Incorrect information. We will not be responsible for delivering the products late or not supplying any part of them if this is caused by you not giving us accurate and appropriate delivery information.

Your rights to end the contract

If you change your mind about your order after it has been placed, you may cancel your order and receive a full refund provided you let us know within 14 days of your order being placed. To cancel your order, please let us know by emailing shop@pollysbrew.co

Where you have notified us that you wish to cancel your order, you must return the products to us within 14 days thereafter. You can do this by either dispatching the products to us by courier, or by booking a timeslot to return the products to us at the brewery.

Please note original delivery charges as well as the cost of return postage and packaging are your sole responsibility and are non-refundable, unless you are returning the products due to an issue which is our fault.

Once your order has been returned we will get in touch to let you know it has been received and your refund has been processed. Refunds will be issued back to your original method of payment.

Please note, if the products you wish to return have been opened or damaged, you will not be entitled to a refund.

Price and payment

The price of the product (which includes VAT) will be the price indicated on the order pages when you placed your order.

It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order.

Discount codes and coupons

We may offer discount codes on our webstore from time-to-time, which can be applied against full-price products on our website. Our discount codes cannot be applied against promotional packs, postage or packaging costs.

We reserve the right to suspend, change, refuse or withdraw any discount we have offered at any time.

How we may use your personal information

We will only use your personal information as set out in our privacy policy.

Other important terms

We may transfer our rights and obligations under these terms to another organisation.

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
